RUSH is a healthcare marketplace platform that connects patients with healthcare providers, pharmacies, and laboratories. Our services include:

• Healthcare Appointments: Booking emergency and scheduled appointments with healthcare providers for online consultations, in-person visits, and home visits.
• Pharmacy Services: Ordering prescription and over-the-counter medications for delivery.
• Laboratory Services: Scheduling diagnostic tests and sample collections from your home.

3. User Registration and Accounts

To access certain features of our Platform, you may be required to create an account. When you register, you agree to:

• Pharmacies: Partner pharmacies must comply with all applicable laws, dispense medications accurately, and maintain quality standards.
• Laboratories: Partner labs must maintain proper certifications, follow standard testing protocols, and deliver accurate results.

5. Healthcare Services

5.1 Medical Advice: The Platform facilitates connections with licensed healthcare providers but is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of qualified healthcare providers with questions regarding medical conditions.

5.2 Emergency Situations: While we offer emergency consultations, the Platform is not designed for life-threatening emergencies. In case of a medical emergency, immediately contact local emergency services.

5.3 Provider Relationships: RUSH does not employ healthcare providers. We facilitate connections between patients and independent providers who are solely responsible for the care they provide.

6. Payment Terms

6.1 Fees: Fees for services are set by the healthcare providers, pharmacies, and laboratories. RUSH may charge service fees for using the Platform, which will be clearly disclosed.

6.2 Payment Methods: We accept various payment methods, including credit/debit cards and digital wallets. By providing payment information, you represent that you are authorized to use the payment method.

6.3 Cancellations and Refunds: Cancellation and refund policies are outlined in our Refund Policy, which is incorporated into these Terms by reference.

7. Privacy and Data Protection

7.1 Data Collection: We collect and process personal and health information as described in our Privacy Policy.

7.2 Medical Records: Healthcare providers maintain medical records according to applicable laws and professional standards. RUSH facilitates access to these records but is not responsible for their content.

7.3 Data Security: We implement reasonable security measures to protect your information, but no data transmission or storage system is 100% secure.

8. Intellectual Property

8.1 Platform Content: All content on the Platform, including text, graphics, logos, icons, and software, is the property of RUSH or our licensors and is protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License: We grant you a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes.

8.3 Restrictions: You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information obtained from the Platform.

9. Prohibited Conduct

You agree not to:

• Use the Platform for any illegal purpose or in violation of any laws.
• Impersonate any person or entity or falsely state your affiliation.
• Interfere with or disrupt the Platform or servers or networks connected to the Platform.

10. Limitation of Liability

10.1 Disclaimer: THE PLATFORM AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

10.2 Limitation: TO THE FULLEST EXTENT PERMITTED BY LAW, RUSH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

10.3 Healthcare Services: RUSH IS NOT RESPONSIBLE FOR THE QUALITY, SAFETY, OR LEGALITY OF HEALTHCARE SERVICES PROVIDED BY THIRD-PARTY PROVIDERS ON OUR PLATFORM.

11. Indemnification

You agree to indemnify, defend, and hold harmless RUSH and its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your use of the Platform, violation of these Terms, or infringement of any rights of a third party.

12. Modifications to Terms

RUSH reserves the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on the Platform. Your continued use of the Platform after such modifications constitutes your acceptance of the revised Terms.

13. Termination

RUSH may suspend or terminate your access to the Platform at any time for any reason without notice. You may terminate your account by contacting us. Upon termination, certain provisions of these Terms will survive.

14. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of India. Any dispute arising from these Terms shall be resolved through arbitration in accordance with the rules of the Indian Arbitration and Conciliation Act, 1996, with the place of arbitration being Mumbai, India.
